1. Agreement
By using the Sky Outsource website (skyoutsource.com and its subdomains) or the customer portal (portal.skyoutsource.com) you agree to these terms. If you use them on behalf of a company, you confirm that you are allowed to accept these terms for it. If you do not agree, please do not use them.
The services we provide to you (cloud servers, security, infrastructure support and others) are governed by your quote or service agreement with us. These terms cover the website and the portal.
2. Who you are contracting with
“Sky Outsource”, “we” and “us” mean Sky Outsource Inc. (Panama) or Sky Outsource LLC (United States). The entity that issues your invoices is the one you are contracting with.
3. Using the website
You may use the website for lawful business purposes. Do not attempt to disrupt it, probe it for weaknesses without our written permission, or use it to send spam or malicious content. The free tools on tools.skyoutsource.com and ots.skyoutsource.com are provided for legitimate use and may be limited or changed at any time.
4. Customer portal: end-user license
If you have a customer portal account, we grant your organization a limited, non-exclusive, non-transferable, revocable right to access and use the portal for its own internal business purposes, to view its billing information (invoices, balances and payments) with Sky Outsource, for as long as it is our customer. The portal is licensed, not sold.
You agree not to:
- share your sign-in details, or let anyone who has not been authorized by us use your account;
- try to access another customer’s information or any part of the portal you were not given access to;
- use automated means (scripts, crawlers) to collect information from the portal, or copy, resell or offer the portal to others;
- reverse engineer the portal or interfere with its operation or security.
We may suspend or remove access if these terms are broken or to protect the security of the portal.
5. Accounts and security
Each customer can have up to two portal users, invited by us by e-mail. You are responsible for keeping your password and your e-mail account secure, because sign-in verification codes are sent to your e-mail address. Tell us immediately if you think someone else has used your account.
6. Billing information in the portal
The invoices and payments shown in the portal come from our accounting system (QuickBooks Online). They are refreshed automatically about every 20 minutes and checked in full every night, so a very recent change may not appear straight away. The invoice issued by Sky Outsource is always the authoritative document. The portal does not process payments; pay as indicated on each invoice. If something looks wrong, tell us at sales@skyoutsource.com.
7. Third-party services
QuickBooks and Intuit are registered trademarks of Intuit Inc. Sky Outsource is not affiliated with or endorsed by Intuit. Our use of QuickBooks is subject to Intuit’s own terms. Links to other websites are provided for convenience and we are not responsible for their content.
8. Intellectual property
The website, the portal, their design and software, and the Sky Outsource name and logo belong to us or our licensors. These terms give you no ownership of them. Information about your own business that appears in the portal remains yours.
9. Availability and changes
We work to keep the website and portal available, but we do not promise they will be uninterrupted or error-free. We may perform maintenance, and we may change or discontinue features.
10. Disclaimer
To the extent the law allows, the website and the portal are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. This does not affect any warranty stated in your service agreement with us.
11. Limitation of liability
To the extent the law allows, Sky Outsource is not liable for indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of the website or portal. Our total liability for claims relating to the website or portal is limited to the amount you paid us for the related service in the three months before the claim. Nothing in these terms limits liability that cannot be limited by law.
12. Suspension and termination
You can stop using the portal at any time. We may suspend or end your access if you break these terms, if your organization is no longer our customer, or to protect the security of the portal. When access ends, you can ask us to delete your portal account as described in our Privacy Policy.
13. Governing law
These terms are governed by the laws that apply to the contracting Sky Outsource entity: the laws of the Republic of Panama for Sky Outsource Inc., and the laws of the State of Delaware, United States, for Sky Outsource LLC, without regard to conflict-of-law rules. Disputes will be handled by the competent courts of that jurisdiction, unless your service agreement with us says otherwise.
14. Changes to these terms
We may update these terms. The new version is published on this page with an updated date, and continuing to use the website or portal after that means you accept it.
